CLIENT PRIVACY POLICY OF BUSINESS FOR THE SUPPLY OF TRANSLATION SERVICES
1. Definitions
‘Client’ means the person, firm, organization, statutory or corporate body, together with any subsidiary or associated undertaking, for whom Rossies Translations has agreed to provide the Services pursuant to these terms and conditions of business.
‘Services’ means translation and other associated services required by the Client and specified on the Cost of Estimate Sheet Translation Form.
‘Source Material’ means any documents, materials, element of text, images, graphics, photographs, designs, data, or other information provided by the Client to Rossies Translations relating to the Services.
‘Deliverable’ means the final, translated version of the Source Material or other such document provided by Rossies Translations to the Client pursuant to and resultant from the Services.
‘Cost of Estimate Sheet’ means the form in which details of the required service is specified and to which these Terms of Business are appended. Cost of Estimate Sheet Translation Form, documents uploaded in Rossies Translations’ web site and emailed as PDF attached. Also, pictures of the files via secure telephone system.
1.B.- The headings contained in these Terms are for convenience only and do not affect their interpretation.
2. Supply of Services
2.A.- If the Services are booked via telephone or email, the Client shall accept the Translation Service Order Acceptance via email or text, at Rossies Translations to acknowledge the Client’s acceptance of the Services and charges outlined in the Cost of Estimate Sheet before Rossies Translations undertake any work on their behalf. Any changes or additions to the Services or these terms and conditions must be agreed in writing by Rossies Translations and shall remunerate Rossies Translations for any work ordered in this manner in accordance with Rossies Translations’ provided rates for its services
2.B.- The Client at its own expense shall supply Rossies Translations with all necessary Source Material within sufficient time to enable Rossies Translations to provide the Services. The Client shall be responsible for and therefore ensure the accuracy of all Source Material.
2.C.- Rossies Translations may correct any typographical or other errors or omissions in any brochure or other published literature relating to the provision of the Services without any liability to the Client.
2.D.- Rossies Translations reserves the right and therefore shall be entitled to sub-contract or otherwise outsource all or any part of the Services to any third party it selects and shall be under no obligation to notify the Client of either the selection of such third party or any subsequent change to the identity of the selected third party.
3. Intended Usage
3.A.- The Client shall clearly indicate the intended use of the translation or other consequence of the Services, otherwise if not mandatory.
3.B.- A translation or other consequence of the Services shall only be used by the Client for information and understanding only and shall therefore only be of sufficient standard for such use by the Client.
3.C.- Should the Client wish to use the Deliverable for any other purpose (including, by way of non-exhaustive examples, for the purpose of external marketing/public domain exploitation or as evidence in civil or criminal proceedings), the Client shall obtain confirmation from Rossies Translations that the translation is suitable for that purpose. Rossies Translations reserves the right to amend and adapt any previously supplied translation, if necessary, for the new purpose.
3.D.- Where the purpose of the translation is not disclosed, Rossies Translations shall execute the translation as if it were for information only pursuant to clause 3.B herein. However, if in Rossies Translations’ Linguistics’ judgement, the apparent intended purpose is otherwise, Rossies Translations shall communicate with the Client, whenever possible, before commencing translation in order to clarify the intended purpose.
4. Delivery
Delivery of the Deliverable to the Client is deemed to have taken place upon posting or delivery to a carrier, or transmission by fax, email, modem or Internet and the risk shall pass to the Client. However, Rossies Translations will retain a copy of the translation and upon request by the Client will forward a further copy free of charge via email PDF when requested within 45 days.
5. Confidentiality
The nature of the work performed, and any information transmitted to Rossies Translations by Client shall be confidential. Rossies Translations shall not without the prior consent of client, divulge or otherwise disclose such information to any person other than authorized employees or authorized subcontractors of Rossies Translations whose job performance requires such disclosure. The provisions of this paragraph shall not apply to the extent that Rossies Translations is required by law to divulge such information or to the extent that such information is or becomes a matter of public knowledge other than by disclosure by Rossies Translations.
6. Gathering and Use of Information
Most data collected by Rossies Translations are used only to help Rossies Translations to better serve its members. It is our general policy to collect and store only personal information that our members and visitors knowingly provide. Such personally identifiable information may include your name, company name, email address, etc. (collectively referred to herein as “Personal Information”). We do not sell, transfer, or disclose any Personal Information we gather at our websites or translation services request to any third parties without your prior consent, except in cases when we believe in good faith that we have a legal obligation to disclose such Personal Information. There may be times when we share aggregate information—such as the number of hits per page—with advertisers, business partners, sponsors, and other third parties in any effort to customize or enhance the content and advertising on our sites for our users.
7. Payments Information
Rossies Translations does not disclose credit card account information provided by its members and customers. When members and customers choose to pay using their credit cards, Rossies Translations submits the information needed to the appropriate clearinghouse through secure sites to conduct the transactions.
8. Copyright
Without prior written agreement to the contrary, copyright in the Deliverable shall vest in Rossies Translations and the Client, upon payment of all outstanding charges to Rossies Translations for the Services is granted a license to exploit such translation for its stated purpose only. Unless otherwise agreed in writing, any published text of the translation shall carry the following statement:

9. Privacy Issues and Links to Other Sites
Rossies Translations website contains links to other websites. Rossies Translations has no control over and is not responsible for the privacy policies or content of such sites.
10. Third Parties
A person or entity that is not an express party to these terms and conditions (and therefore this agreement) has no right under the to rely upon or enforce any of these terms and conditions and Rossies Translations shall have no liability whatsoever to any such third party.
11. “Cookies” and Internet Protocol Addresses
11.A-“Cookies” are files that contain information created by a web server that can be stored on a user’s hard disk for future use. Rossies Translations uses cookies only to facilitate automated activity, store and track passwords, and review navigation patterns. Cookies are not used to disseminate significant information about users over the Internet or to analyze any information that users have knowingly or unknowingly provided.
11.B.-We use your Internet Protocol addresses to help diagnose problems with our server, to administer our website, and to gather broad demographic information.
12. Governing Law & Jurisdiction
These terms and conditions are governed by and shall be construed in accordance with the law of the State of Maryland, United States and are subject to the exclusive jurisdiction of the Courts of the State of Maryland, United States.
